You confirm you are of legal age in your country of residence. You agree to provide accurate, current and complete information and to keep your account credentials secure. You are responsible for activity under your account.
2. OUR PRODUCTS
We try to display products as accurately as possible; colours/appearance can vary by device. Descriptions and availability may change without notice. We may limit sales per person/household/region.
3. ORDERS
Your order is an offer to buy. We may accept or decline at our discretion. An order is accepted when we send an order confirmation and take payment. Please check details carefully before submitting.
Returns are handled under our Return & Refund Policy. Products are for personal use and not for resale.
4. PRICES & BILLING
Prices shown at checkout are the prices in force when you place the order. Unless stated otherwise, prices are shown inclusive of VAT. Shipping fees, if any, are shown at checkout.
You agree to provide valid payment details and authorise us (and Shopify’s payment processors) to charge your payment method for the total amount due.
5. SHIPPING & DELIVERY
Estimated delivery dates are guidance only. We are not responsible for delays outside our control (e.g., carrier delays, customs).
For consumer orders, risk of loss and title pass only when the goods are delivered to you (or a person you nominate), not when handed to the carrier.
6. INTELLECTUAL PROPERTY
All trademarks, logos, text, images and content on the Services are owned by Box Room Gym or licensors. You may use the Services for personal, non-commercial purposes only. No licence is granted other than as necessary to use the Services.
7. OPTIONAL TOOLS & THIRD-PARTY LINKS
Third-party tools/links may be provided “as is.” We do not control and are not responsible for third-party sites, content or terms. Use them at your own discretion.
8. RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify, but your purchase contract is with Box Room Gym. Shopify is not responsible for sales between you and Box Room Gym.
9. PRIVACY
Personal data is processed in line with our Privacy Policy and Shopify’s privacy practices (see Shopify Privacy Policy). By using the Services, you consent to such processing.
10. FEEDBACK & REVIEWS
If you submit reviews or feedback, you grant us a non-exclusive, royalty-free licence to use and display them for store operation and promotion. You warrant you own your content and it does not infringe others’ rights.
11. ERRORS & AVAILABILITY
We may correct errors, inaccuracies or omissions and update information (including pricing/availability) without notice, including after you have placed an order, where permitted by law.
12. PROHIBITED USES
You agree not to misuse the Services (e.g., illegal activity, infringement, malware, scraping, spamming, attempting to bypass security). We may suspend or terminate access for breaches.
13. TERMINATION
We may suspend or terminate your access where we reasonably believe you have breached these Terms. You remain liable for sums due up to termination.
14. DISCLAIMER (STATUTORY RIGHTS UNAFFECTED)
Except as required by law, the Services are provided “as is” and “as available.” Nothing in these Terms affects your statutory rights as a consumer (including rights under the Consumer Rights Directive and Irish law).
15. LIABILITY
We are legally responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence.
We do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any matter that cannot be excluded by law.
We are not liable for business losses (our products are for domestic/private use). To the fullest extent permitted by law, we are not liable for losses not caused by our breach or that were not foreseeable.
16. INDEMNITY (NARROW)
If you use the Services unlawfully or in breach of these Terms and that causes us loss, you agree to reimburse us for reasonable losses directly resulting from that breach.
17. GOVERNING LAW & CONSUMER PROTECTION
These Terms are governed by Irish law. If you are a consumer resident in the EU/EEA/UK, you also benefit from any mandatory consumer protections of your country of residence.
Courts of Ireland shall have jurisdiction, without prejudice to your right to bring proceedings in your home courts where mandatory law allows.
18. ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our consent. We may assign or transfer our rights/obligations at any time.
19. CHANGES TO THESE TERMS
We may update these Terms from time to time. We’ll post the new version with an effective date. Continued use of the Services after changes means you accept the updated Terms.
